These Terms and Conditions (“Agreement”) govern the use of Tone & Flow’s website and services. By using our services or visiting our website, you agree to abide by these Terms. Please read them carefully.

Account Creation and Management

When you create an account with Tone & Flow, you agree to:

• Be solely responsible for maintaining the confidentiality of your account, including any passwords or sensitive information attached to it.
• Provide accurate and up-to-date personal information, and notify us promptly of any changes.
• You must be at least 18 years old to create an account. If you are under 18, you must have the consent of a parent or guardian.

We reserve the right to suspend or terminate your account if we determine that you are violating these Terms or engaging in illegal activities.

Service Availability

Tone & Flow reserves the right to modify or cancel services or classes due to unforeseen circumstances, such as weather, holidays, or other operational issues. We will notify members promptly of any cancellations or changes to our schedule.

Sale of Services

Tone & Flow provides Pilates classes and memberships through our website. By purchasing any service from us, you agree to the following:

• All services are paid for in full when ordered.
• All information, descriptions, or images of our services are provided to the best of our knowledge, but we do not guarantee their accuracy.
• We reserve the right to modify, reject, or cancel orders when necessary. If we cancel an order after payment has been processed, we will issue a full refund to the payment method used.
• No refunds will be issued for any services after they are provided.

Subscription and Cancellation Policy

Your membership subscription will automatically renew each billing cycle unless you notify us of your desire to cancel at least 30 days before the next renewal date.

• Cancellation Policy: To cancel your membership, you must notify us at least 30 days prior to your next payment cycle. If you fail to provide this notice, your membership will continue, and one additional month of fees will be charged. You will retain access to your membership for that additional month.

No refunds will be provided for cancellations.

Payments

We accept the following payment methods:

• Direct Debit

By providing payment details, you authorize Tone & Flow to process payments for your selected services. If any payment is found to be fraudulent or violates these Terms, we reserve the right to cancel or reverse the transaction.

Consumer Protection Law

If the Consumer Protection Act or any other relevant consumer protection legislation applies, these Terms and Conditions will not limit your legal rights and remedies under that legislation. Any conflict between these Terms and the applicable legislation will be resolved in favor of the mandatory provisions of the legislation.

Limitation of Liability

Tone & Flow and its directors, officers, agents, employees, subsidiaries, and affiliates are not liable for any claims, losses, damages, or expenses arising from the use of our website or services. This includes, but is not limited to, damages caused by disruptions, errors, or other unforeseen circumstances.

Indemnification

By using Tone & Flow’s website and services, you agree to indemnify and hold harmless Tone & Flow, its directors, officers, agents, employees, and affiliates from any legal claims, losses, or damages that arise from your actions or violations of these Terms.

User Conduct

Members agree to:

• Respect the studio environment and adhere to instructor guidelines.
• Act responsibly, ensuring a safe and positive experience for themselves and others during classes.
• Any disruptive or inappropriate behavior may result in the termination of membership without a refund.

Force Majeure

Tone & Flow will not be liable for delays or failure in performance due to causes beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, or government regulations.

Changes to Terms

Tone & Flow may update these Terms from time to time. We will notify users of any significant changes by posting a notice on our website or by sending an email. Continued use of our services will be deemed acceptance of the revised Terms.
