Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of Tone & Flow’s website and services. By using our services or visiting our website, you agree to abide by these Terms. Please read them carefully.

Account Creation and Management

By creating an account with Tone & Flow, you agree to:

  • Provide accurate, current personal information.
  • Maintain confidentiality of your login credentials.
  • Notify us of any changes to your information.

Age Requirement:
You must be at least 18 years old to create an account. Minors must have a parent/guardian create and manage the account on their behalf.

Right to Suspend or Terminate:
We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent, abusive, or illegal activities
  • You misuse studio services or booking systems

Service Availability

Tone & Flow reserves the right to:

  • Modify, delay, or cancel services due to operational needs, weather, emergencies, or holidays.
  • Make changes to the class schedule when necessary.

Members will be notified of any schedule changes or cancellations through the WellnessLiving app/email.

Sale of Services

Tone & Flow sells Pilates classes, memberships, class packs, private sessions, and studio rentals.

By purchasing any service, you agree that:

  • Payment is due in full at the time of purchase.
  • Descriptions, images, or details of services are accurate to our best knowledge but not guaranteed.
  • We may decline or cancel an order. If payment was processed, a full refund will be issued.
  • No refunds are provided after services have been delivered or used.

Membership Subscription & Cancellation Policy

Auto-Renewal

All monthly memberships automatically renew every billing cycle unless canceled properly.

Cancellation Requirements

To cancel a membership:

  • You must provide written notice at least 30 days before your next renewal date.

  • The 30-day window is counted from the upcoming renewal date, not from the day the request is submitted.

If Notice Is Not Given

If you fail to provide proper notice:

  • Your membership will renew for one additional month,

  • The card on file will be charged,

  • You will keep class access for that month,

  • The membership will automatically cancel afterward.

Refunds

  • No refunds are issued for unused time after billing.

No refunds for late cancellation requests.

Payments

Accepted payment methods include:

  • Credit Card

  • Direct Debit

By providing payment information, you authorize Tone & Flow to:

  • Charge your card for recurring memberships

  • Charge fees for late cancels or no-shows

  • Charge outstanding balances

If fraudulent activity is detected, Tone & Flow reserves the right to reverse or cancel the transaction.

Consumer Protection Law

If the Consumer Protection Act or any other relevant consumer protection legislation applies, these Terms and Conditions will not limit your legal rights and remedies under that legislation. Any conflict between these Terms and the applicable legislation will be resolved in favor of the mandatory provisions of the legislation.

Limitation of Liability

Tone & Flow Studio Inc., including its owners, instructors, staff, and affiliates, is not liable for:

  • Injuries or damages arising from participation in classes

  • Website outages or technical issues

  • Scheduling disruptions

  • Any indirect, incidental, or consequential damages

This limitation does not apply in cases of gross negligence or intentional misconduct.

 Indemnification

You agree to indemnify and hold harmless Tone & Flow, its employees, instructors, owners, and affiliates from any claims or legal actions resulting from:

  • Your misuse of services

  • Your violation of these Terms

  • Your actions during classes or on studio premises

User Conduct

All clients agree to:

  • Follow instructor directions during class

  • Behave respectfully toward staff and other members

  • Maintain a safe and positive environment

Tone & Flow reserves the right to terminate membership without refund for:

  • Aggressive, disruptive, or unsafe behavior

  • Violation of studio policies

Force Majeure

Tone & Flow is not liable for delays or failure to perform due to events outside our control, including:

  • Natural disasters

  • Pandemics

  • Government restrictions

  • Power outages

  • Strikes or facility emergencies

Changes to These Terms

We may update these Terms as needed. If changes are significant, we will notify clients by:

  • Posting updates on our website, or

  • Sending an email notification

Continued use of Tone & Flow services constitutes acceptance of the revised Terms.
